Terms of Service

PS Games mobile apps and the psgames.com.au website

These Terms of Service ("Terms") apply when you download or use any app made by PS Games, or use our website at www.psgames.com.au. "PS Games", "we", "us" and "our" means PS Games Pty Ltd (PS Games P/L), ABN 74 608 950 894, 901/2 Newquay Promenade, Docklands VIC 3008, Australia. "You" means the person using our apps or website.

By downloading, installing or using our apps or website, you agree to these Terms. If you don't agree, please don't use them. Nothing in these Terms takes away rights you have under the Australian Consumer Law or other laws that can't be excluded (see section 11).

1. Our apps

These Terms cover all of our apps, including:

  • Hong Kong Style Mahjong (Android and iOS) – free with ads, with a Remove Ads in-app purchase. Includes play against the computer, online multiplayer, private games and tournaments with a 6-digit code, public leaderboards and the in-game Coach.
  • Hong Kong Style Mahjong 3D (Android and iOS) – free with ads, with in-app purchases (coin packs and Remove Ads), accounts and online play.
  • Chessmith (Android and iOS) – free, with online play, a public leaderboard and an optional AI coach that uses your own OpenAI API key.
  • Silicon Schism (Android and iOS) – an online game played against our game server, with sign-in by Google or Apple. Free on Google Play and a paid download on the App Store.
  • Sudoku Challenge (Android) – free with ads.
  • Showdown Poker (Android and iOS) – free with ads, with accounts, online play, clubs and tournaments.
  • UnRecorded (Android) – a meeting-notes app that keeps your data on your device and uses your own AI provider API key.

Some apps have extra rules shown in the app (for example game rules, tournament rules or a store description). Those rules apply together with these Terms. If they conflict, these Terms apply unless the in-app rules say otherwise.

2. Your privacy

Our Privacy Policy explains what information each app collects, who can see it, where it is stored and how to ask us to delete it. Please read it with these Terms.

3. Who can use our apps

Our apps are made for a general audience and are not directed to children under 13. You must be at least 13 years old to use our apps. If you are under 18, you should have a parent or guardian's permission to use our apps and to make any purchase.

4. Accounts, sign-in and display names

4.1 Most of our apps don't need an account with a password. Depending on the app, you may be signed in anonymously, through Google Play Games or Apple Game Center, with Sign in with Google or Sign in with Apple, or with an email address or username and password. The Privacy Policy explains which app uses which method.

4.2 You are responsible for activity on your account and for keeping your sign-in details secure. Tell us promptly at paul.vella@psgamesonline.com if you think someone else has used your account.

4.3 Your display name, username or call sign is visible to other players. It must not:

  • impersonate anyone, including PS Games staff;
  • be offensive, abusive, hateful, sexually explicit or discriminatory;
  • contain an email address, web address, phone number or advertising; or
  • infringe anyone else's rights.

We may change or remove a name that breaks these rules.

4.4 Don't sell, buy, share or transfer accounts, and don't create accounts using automated means.

4.5 Some progress (for example in Hong Kong Style Mahjong games against the computer) is stored only on your device. If you delete the app or change devices without a backup, that progress may be lost. Where an app offers a backup or account, we will take reasonable care with it, but you should not rely on us to keep progress indefinitely (see section 9).

5. Playing online and with other people

Online play, private games, tournaments, leaderboards, clubs and chat-like features are meant to be fun for everyone. When you play online you agree not to:

  • cheat, or use bots, scripts, modified apps, emulators or other software to gain an unfair advantage, alter results or automate play;
  • exploit bugs or glitches – please report them to us instead;
  • deliberately disconnect, stall, or abandon games to grief other players or to manipulate results or leaderboards;
  • collude with other players, or use multiple accounts or devices to boost your own results;
  • harass, threaten, abuse, or discriminate against other players;
  • share private game codes or invite links publicly in a way that lets others disrupt a private game;
  • interfere with, overload, scan, or try to gain unauthorised access to our servers, databases or other players' data; or
  • use our apps for any unlawful purpose or for gambling with real money.

Computer players. To keep games running, some online games may fill an empty or abandoned seat with a computer player (for example, if a host or player leaves or loses connection). Tables may include computer-controlled players (bots), which may be labelled in-game.

Availability. Online games depend on internet connections and on our servers and service providers (such as Google Firebase, Amazon Web Services and Exit Games/Photon). Games may be interrupted, lost or reset, for example if a player disconnects or during maintenance. We may remove abandoned tables, and we may reset or correct leaderboards if we find errors or cheating.

6. Our response to breaches

If we reasonably believe you have broken these Terms, we may, depending on how serious it is: remove your display name, leaderboard entries or content; warn you; or suspend or permanently block you from online features or from an app. Where reasonable we will tell you why. This does not limit any other rights we have by law.

7. In-app purchases, paid apps and virtual items

7.1 Payments. In-app purchases (such as Remove Ads in Hong Kong Style Mahjong, currently A$2.99 in Australia; local store pricing may vary by country, and coin packs and Remove Ads in Hong Kong Style Mahjong 3D) and paid downloads (such as Silicon Schism on the App Store) are sold and processed by Google Play or the Apple App Store. Their terms of sale and payment also apply. We never see your card or bank details. Prices are shown in the store before you buy and may change from time to time.

7.2 Remove Ads. Remove Ads turns off ads in the app it was bought in, on the store account it was bought with. To restore it on a new or reinstalled device, sign in to the same Apple ID or Google account you bought it with and use the app's Restore Purchases option where available. On Android, if our older paid version of Hong Kong Style Mahjong is installed, ads are removed at no charge.

7.3 Virtual items. Coins, chips, diamonds, in-game credits, XP, ranks, winnings and other virtual items or currencies have no real-world money value. They are a limited, personal, non-transferable licence to use that content in the game. They can't be sold, traded, transferred or exchanged for real money or anything of value outside the game, and we don't buy them back. Winnings on leaderboards and in tournaments are virtual only.

7.4 Showdown Poker rewards and redemptions. Rewards, coins, chips and any redemptions in Showdown Poker follow the rules shown in the game. They have no cash value, are not transferable, and can't be exchanged for money. We may change or end them at any time, and we may add specific terms for them in the app.

8. Advertising

Some of our free apps show ads, which keeps them free. Ads are provided by Google AdMob and, in Hong Kong Style Mahjong for Android, by AppLovin through AdMob. Some apps offer optional rewarded ads that you can choose to watch for an in-game reward. We are not responsible for the content of third-party ads or for products or websites they link to. Our Privacy Policy explains how ads use data and how to change your ad choices.

9. Changes to the apps and service

We regularly update our apps, and we may add, change or remove features, games, levels, leaderboards or online services. We may also stop offering an app or close its online service. If we close the online service of an app you paid for, or remove a feature you paid for, we will give reasonable notice in the app or on our website where we can, and you keep any rights you have under the Australian Consumer Law. Some features may need an up-to-date version of the app and a compatible device and operating system.

10. Intellectual property

10.1 Our apps, website, games, artwork, tile sets, sounds, music, text, software and trade marks are owned by PS Games or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to download and use our apps on devices you own or control, for personal, non-commercial entertainment, in line with these Terms and the rules of the app store you got the app from.

10.2 You must not copy, modify, distribute, sell or rent our apps or content, or decompile, reverse engineer or try to extract source code, except where the law allows this and can't be excluded.

10.3 Some apps include third-party software and open-source components, which are licensed under their own terms.

10.4 If you send us feedback, ideas or bug reports, we may use them freely to improve our apps without any obligation to you.

11. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited ("Non-Excludable Rights"). If you live outside Australia, you may also have consumer rights under the laws of your country that these Terms do not affect.

12. Disclaimer and limitation of liability

12.1 Subject to your Non-Excludable Rights, our apps and website are provided "as is" and "as available". We don't promise that they will always be available, uninterrupted, error-free or secure, or that your progress, scores or virtual items will never be lost.

12.2 Subject to your Non-Excludable Rights, we are not liable for any indirect or consequential loss, or for loss of data, progress, virtual items, profits or opportunity, arising from your use of (or inability to use) our apps or website.

12.3 Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, and the goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited (at our option) to supplying the services again or paying the cost of having them supplied again.

12.4 Subject to your Non-Excludable Rights under the Australian Consumer Law, our total liability to you for all claims relating to our apps or website is limited to the greater of the amount you paid to PS Games (through the app store) in the 12 months before the claim, or A$100.

12.5 Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud, to the extent the law does not allow it.

12.6 Third-party services we rely on or that you choose to use (such as Google Play, the App Store, Google Play Games, Game Center, Google and Apple sign-in, Facebook, OpenAI or another AI provider you choose with your own API key) are provided under their own terms. For apps with AI features that use your own API key (Chessmith and UnRecorded), you are responsible for your agreement with, and any charges from, that provider, and AI-generated explanations or summaries may be inaccurate.

13. Ending these Terms

You can stop using our apps at any time by uninstalling them. You can ask us to delete your data as described in section 15. We may suspend or end your access as set out in section 6, or if we close an app or its online service (section 9). Sections that by their nature should continue (including 7.3, 7.4, 10, 11, 12 and 14) continue after these Terms end.

14. Governing law and disputes

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that can hear appeals from them. If you are a consumer living in another country, you may also have the benefit of mandatory consumer laws and courts of your country.

If you have a problem, please contact us first at paul.vella@psgamesonline.com and we will try to resolve it within 30 days. If we can't, you can contact Consumer Affairs Victoria (https://www.consumer.vic.gov.au) or your local consumer protection agency.

15. Deleting your data

To ask us to delete your data, email our customer care team at customer-care@ps-games-pl.odoo.com with the subject "Data deletion request" and tell us which app your request is about. See the Privacy Policy for details.

16. Changes to these Terms

We may update these Terms from time to time, for example when we add new apps or features, or when the law changes. We will post the updated Terms on this page with a new effective date and, for significant changes, we will also let you know in the app or on our website where we can. If you keep using our apps after the changes take effect, the updated Terms apply. If you don't agree with them, please stop using the apps.

17. General

If any part of these Terms is found to be invalid or unenforceable, the rest of these Terms continue to apply. If we don't enforce a right straight away, we haven't given it up. You may not transfer your rights under these Terms. We may transfer ours, for example if an app is sold, provided your rights are not reduced. These Terms, the Privacy Policy and any in-app rules are the whole agreement between you and us about our apps and website.

Apple App Store. If you downloaded an app from the Apple App Store, Apple's Standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. These Terms are between you and PS Games, not Apple. Apple has no obligation to provide maintenance or support for our apps and is not responsible for addressing any claims relating to them. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
